Terms of Use

Last updated: set the day BoomSort launches

These Terms govern the use of BoomSort ("the App"), developed by Vincenzo Famao ("we", "the developer"). By downloading or using the App you agree to these Terms.

1. License to use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal, non-commercial use, in accordance with Apple's Standard EULA, which applies in addition to these Terms.

2. In-app purchases

BoomSort+ is a one-time in-app purchase (not a subscription): it permanently unlocks the additional modes and content described in the App, on the Apple ID it was purchased with, with Family Sharing support. There are no auto-renewals or recurring charges. Payments are handled entirely by Apple; for refunds or billing issues please refer to Apple's support policies, as we have no access to or control over payments.

3. Acceptable use

You agree not to:

decompile, reverse-engineer or tamper with the App beyond what applicable law allows;
use exploits, bots, or tampering to alter Game Center scores, leaderboards or achievements;
use the App for any unlawful purpose.

4. Content and intellectual property

The App's code, music, text and in-game graphics are the developer's work: the game is drawn in code and the soundtracks are synthesized in code. BoomSort is an independent, standalone creation.

5. Third-party services

The App uses Game Center (Apple) for leaderboards and achievements and — if enabled — iCloud sync (Apple) for profile backup; use of these is also governed by the relevant Apple terms. It sends anonymous usage statistics through TelemetryDeck and reads a configuration file hosted on this website. Details in the Privacy Policy.

6. No warranty

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including (to the extent permitted by law) warranties of merchantability or fitness for a particular purpose. We do not guarantee the App will always be error-free or uninterrupted.

7. Limitation of liability

To the extent permitted by applicable law, the developer is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the App.

8. Changes to the App and these Terms

We may update, modify, or discontinue the App or parts of it at any time. We may update these Terms by posting a revised version on this page with a new date.

9. Governing law

These Terms are governed by Italian law, except where mandatory law in your country of residence provides otherwise.

Questi Termini regolano l'uso di BoomSort ("l'App"), sviluppata da Vincenzo Famao ("noi", "lo sviluppatore"). Scaricando o usando l'App accetti questi Termini.

1. Licenza d'uso

Ti concediamo una licenza personale, non esclusiva, non trasferibile e revocabile per usare l'App su dispositivi che possiedi o controlli, per uso personale e non commerciale, in conformità ai Termini standard di licenza per le app (EULA) di Apple, che si applicano in aggiunta a questi Termini.

2. Acquisti in-app

BoomSort+ è un acquisto in-app una tantum (non un abbonamento): sblocca in modo permanente le modalità e i contenuti aggiuntivi descritti in-app, sull'Apple ID con cui è stato acquistato, con supporto a Condivisione in famiglia. Non ci sono rinnovi automatici né addebiti ricorrenti. I pagamenti sono gestiti interamente da Apple; per rimborsi o problemi di fatturazione fai riferimento alle policy di supporto Apple, poiché non abbiamo accesso né controllo sui pagamenti.

3. Uso corretto

Accetti di non:

decompilare, decodificare o manomettere l'App oltre quanto consentito dalla legge applicabile;
usare exploit, bot o manomissioni per alterare punteggi, classifiche o achievement di Game Center;
usare l'App per scopi illegali.

4. Contenuti e proprietà intellettuale

Codice, musica, testi e grafica dell'App sono opera dello sviluppatore. BoomSort è un'opera indipendente e autonoma, non affiliata né sostenuta da terze parti.

5. Servizi di terze parti

L'App usa Game Center (Apple) per classifiche e achievement e — se attivata — la sincronizzazione iCloud (Apple) per il backup del profilo; l'uso di questi è regolato anche dai termini Apple relativi. Invia statistiche d'uso anonime tramite TelemetryDeck e legge un file di configurazione ospitato su questo sito. I dettagli sono nell'informativa privacy.

6. Assenza di garanzia

L'App è fornita "così com'è" e "come disponibile", senza garanzie di alcun tipo, esplicite o implicite, incluse (nei limiti consentiti dalla legge) garanzie di commerciabilità o idoneità per uno scopo particolare. Non garantiamo che l'App sia sempre priva di errori o interruzioni.

7. Limitazione di responsabilità

Nei limiti consentiti dalla legge applicabile, lo sviluppatore non è responsabile per danni indiretti, incidentali o consequenziali derivanti dall'uso o dall'impossibilità di usare l'App.

8. Modifiche all'App e ai Termini

Possiamo aggiornare, modificare o interrompere l'App o parti di essa in qualsiasi momento. Possiamo aggiornare questi Termini pubblicando la versione rivista su questa pagina con una nuova data.

9. Legge applicabile

Questi Termini sono regolati dalla legge italiana, salvo diversa disposizione inderogabile di legge applicabile nel tuo paese di residenza.
